The Differences Between Title IX, Sex and Title VI Race
David Gergen: Both Title IX, sex and Title VI race foreclosed the possibility of discrimination on the basis of sex and on race. But isn't that where the gender thing becomes all the better for this case? Because it is a truly one-to-one,. unlike the race thing where you have all sorts of different races and shrug gender. For every man you admit under a gender affirmative action policy, you are by definition not admitting a woman who is otherwise more qualified. It's amazing how little the actual language of the governing statutes that govern all institutions of education that are federally funded played into the conversation., Gergen says.
