Affirmative Action in Higher Education
The purpose of the 14th amendment was to dismantle white supremacy. Most of the reconstruction legislation was very race conscious in trying to undo the generations long harms of slavery. So if they brought that lens of originalism and textualism to looking at affirmative action then they might but of course they're just caught up in a right wing ideological crusade, says Raskin.
