The Negligence Standard in the Defamation Case
Under the bill, Donald Trump would be considered a public figure if he took actions not pursuant to his duties. The actual text of the bill says you look at the context in which it's discussed, and if it isn't related to the reason why they are a public official, a lower standard applies. But there are other ways that they undermine actual malice as well.
