The Role of the 14th Amendment in the Decisions in the Bocke Case
There's two different legal provisions in play here. One is the 14th amendment, which just says no one shall be denied equal protection of the law. The other is a law called Title VI, and it just uses different language. And so there's a stronger statutory argument against affirmative action.
