What Happens in California During the COVID Litigation?
There is a real problem. There are brave trial court judges. I mentioned it on reasonable down at the time. Judge Chalfunte in Los Angeles Superior Court did an amazing 53 page analysis on outdoor dining. He gave the county not one, not two, but three tries to deal with it. And he just debunked the whole thing and basically said you can't just outsource your role as an elected official to an unelected bureaucrat for lack of a better term. But what ended up happening goes up to the court of appeal and three justices who I have a great deal of respect for who basically just deferred. They first found that, and this is how they do the constitutional analysis.
