David Waters had already been sentenced to eight years for possessing a weapon as a felon on top of a 60-year sentence for violating the terms of his deferred adjudication. After seeing the results of Gary Carr's trial in January 2001, David Waters and his lawyer cut a deal with federal authorities. Waters agreed to plead guilty to a conspiracy charge if allowed to transfer out of Texas's state prison system to a federal facility. In return, David Waters would tell all, including leading investigators to exactly where the bodies were buried.
