The Defense's Better Argument in the Tax Evasion Case

David Gergen: In the plea agreement, it says that this includes all facts encompassed in the plea agreement on the misdemeanors. The defense walked in and was like, we have a pretty big immunity agreement here,. And the prosecution appears to have walked in not knowing that. He asks four times if you can point out any precedent for something like this? And four times the government says no. Why did they do it  this way? Because Donald Trump won the election or any potentially Republican candidate would say he violated his pre-trial diversion because it's a contract between two people who are only going to be able to get up against each other at trial.
