Artists are already filing lawsuits against these AI companies, you know, to prevent them from using copyrighted their copyrighted artwork without permission. There's no definitive legal stance even on if it's legal to train machine learning models on copyrighted works. That seems like it should be illegal probably, but it's a gray area because none of the generated content is like a copy.
