Only the idea of a higher law or standard of just justice prior to written law can give sense to such claims. Aristotle was describing some of the most commonly recognized contents of natural law when, after defining virtue in terms of mean he names three kinds of actions that are always prohibited: theft, adultery and murder. Even the most innovative attempts describe a basis for social life and morality other than natural law still end up capturing a sense of obligation prior to human law.
