Is Qualified Immunity a Good Thing?

The law currently is set up so that if there is not a prior judgment on a specific set of circumstances, unless there is, then qualified immunity does not come into play. I would require courts to determine whether a constitutional violation has occurred and then determine whether it was clearly established at the time. That would at the very least allow case law to develop and would narrow the field of uncertainty in the future.
