What Is Equal Protection?
The way to think of equal protection is not, ah, all people treated equally by the at all times. It is similarly situated people should be treated alike. And so essentially what with a lot of equal protection arguments are over who is similarly situated. A racial racial classification is considered a suspect classification and it receives the highest level of legal scrutiny. But in almost all circumstances, a racial classification is going to fall.
