The Importance of Precedent in Court Decisions
Courts are governed by precedent. So we are not reaching decisions from whole cloth. We have a long body usually not always of law that gives us guidance in terms of how other courts have decided to matter. The Court of Appeals is a very significant constraint on people going off the rails and I think it has more to do with people's humanity and sense of self.
