The Chief Justice's Decision in the Masterpiece Cake Shop Case
The Masterpiece Cake Shop case ended up being decided in 2018. Jack Phillips had been sanctioned for refusing to bake this cake for these two gay men who wanted to celebrate their marriage. Incoms, the Pavan versus Smith one, and Anthony Kennedy thought that they could just summarily reverse the Arkansas Supreme Court decision. But a little known rule that isn't made public, but I've learned about it, is that you need six votes for a summary reversal.
