The Court's Decision in Morrison's Is a Bit More Nuance Than the Decision in Berkeley's
Robert King says the court went a bit too far with its decision in berkeley's case. He argues that at its heart is this hard edged, unshakable principle that defendants can't be liable for the acts of independent contractors. And if policy reasons do apply to independent contractors for making them vicarious, ability is not obvious why liability shouldn't follow.
