The Systemic Aspect of International Law

International law of its nature engages political considerations. Treaties that are themselves often the outcome, or they are the outcome of a political process between states. It's not a mask for power if it were otherwise states would have no conceivable reason to submit their disputes to law. The international legal system is not centralized by the deliberate design of states through their treaty engagements. We start with that and our responsibility as lawyers and scholars is to make sense of that set of heterogeneous choices by states.
