The Importance of Constitutional Courts in Democracy

The temptation to dip into the funds of the state, either for personal enrichment or for political aggrandizement seems to be a constant in these populist regimes. And I argue that when institutions get weakened, then you have more and more individual discretionary authority. This is basically an al Capone type strategy: These individuals can't be held legally accountable for being bad leaders. But they can be held accountable for their transgressions, which are tied into the way they govern.
