Is DACA Unconstitutional?
The Fifth Circuit is sending to the lower court judge and this judge already ruled once that DACA was unconstitutional. The whole point of the regulation was just to eliminate the notice and comment argument, it wasn't to change anything else. And so I would say with 99.99999930 that the district court and the Fifth Circuit are going to invalidate the rule. Then the case will go to the Supreme Court.
