Can the Crime of Aggression Be Effectively Operationalized?

Self defence and humanitarian intervention are going to be the two most tricky scenarios. Under article 51 of the u.N. Charter, you need an armed attack to trigger the right of self defence. A premptive strike, like the invasion of irac in two thousand three would not qualify as self defence. So i actually think that a proper court, like international criminal court or regional court, then they can decide what's illegitimate and what's legitimate. The big question is who should be judge? I believe that most states may be,. not some western states, but other countries.
