John Avlon: Chief Justice Roberts sort of undercuts all his arguments that diversity and blah, blah,. blah, leadership. There's no discernible educational benefits using the squishy standards. And then he carves out military schools. It seems to me that what happened is that Justice Sotomayor brought up this issue in her dissent.Avlon: Maybe it was hard to put together six votes on military academies. But yeah, the big issue in Gruder somehow remains unresolved after today. That is kind of freaking crazy.
