The obstruction statute has been challenged by a number of defendants. There's uncertainty still about whether d o j can successfully use this provision. I think nine or ten judges have said its fine. And i actually have a thought about this prete because the ten or so judges who have said that d oJ can go ahead in charge under this statute, they are district judges, they are trial judges. These cases, some of them, will go up on appeal, and a court of appeals, the district of columbia court of appeals,. will be asked to rule on that same issue. Even their ruling won't be final.
