An objective judicial opinion would basely write this and the sayme t we try to figure out what is equal protection? Yes, yes. I don't want to elevate to day, well, this is to day's opinion, or to day's consensus, as if there were consense, is right? But to the extent that we can say, well, most people to day think this, versu what most people thought in 18 65, or whatever, i don't wants to, in effect, privilege the contemporary over the historical.
