Is the West Virginia Case a Good Case for the Federal Reserve?
The West Virginia case is a good one. It's hard to sue the Fed to say you have the discretion to do this other thing. And so there's no lawsuit that, you know, Conti Brown versus the Federal Reserve would never occur because I would lose that case. But my legal critique of 13, three is a little bit different, subtly but importantly different.I don't think that the Fed acted illegally. I think what the Fed didn't do and claiming though we can't do this because it's illegal, that's false.
