Microsoft is going to fight it out in the appeals process until it's exhausted every legal move and its army of lawyers are far from calling it quits. Seven appeals court judges host the next round of the trial and question both sides harshly. In June, 2001, the seven judges ruled that Judge Jackson was so biased he must be recused from the case. Settlement talks between Microsoft and the Department of Justice restart with the DOJ now under a more business friendly Republican administration. The upshot? Microsoft stays whole.
