The Unenumerated Rights in the Constitution
Sures: It's a problem throughout the supreme court's history why some precedents are bad enough to overturn. When we think about a a gay marriage and rights to privacy in your own bedroom, those were all overturning precedent. In order to say that roe can't be overturned for that reason, you have to be able to nguish why plessy was different, why bowers was different. And i haven't seen a good argument for that yet.
