The Government's Role in Copying Accounts
The judge says that even if these providers were state actors, running a copy of the account that the defendant could not control doesn't amount to a seizure. Of course, as we've noted and as Orrin Kerr notes, it is a request in name only. I mean, they're being forced to do this. And as you said, this data would not be copied without the government's involvement.
