The Dangers of Bad Regulation
In practice, companies that are sued often retreat into their shelves. They do not defend themselves very well because if nothing else, their lawyers are telling them not to get involved in issues where anyone is going to notice or counter to them. And then it gets even a little bit worse because if things get to what is called the remedy stage where they talk about, all right, we're going to settle it. What should we do to settle it? At that point, the settlement is often negotiated behind closed doors with a bunch of ruling lawyers and this is going to shock and surprise some listeners. The remedies that come out are often very anti-competitive and rather resemble cartels in that they cut down
