Index Providers, You Don't Have to Register, You're Not Regulatory
In the past, index providers didn't have to register as advisers. The Supreme Court ruled against this in a case that went all the way up to the supreme court. If you want to be an index provider and avoid registration, you'd better make damn sure your index is 100% quant. And if you're just a one man band and the only client is yourself with the fund you're sponsoring, that' where it gets tough.
