I've Always Been Uncomfortable With Bivins
Bivins is a judge made legal doctrine, along with qualified immunity. Bivins itself will continue to survive in its very, very limited form but it's just kind of made up. The government has put together number of ways in which you can recover against the government if the government violates your right. So that is not the only way to deal with governmental misconduct.
