The Federalism Problem
How can it be that you have enforceable ethics rules for the rest of the judiciary? They're not at the top, but they're life-tenured. Why is being on the Supreme Court so much different and so much more carefree than being on the Fifth Circuit? I'm sure Merrick Garland's hair was on fire when he saw that. For any other judge, something like this would be a serious matter.
