What Should Be a Right?
I'm not sure I saw Dworkin as saying something that was quite that broad. It wasn't just ought to be a right, but he almost uses those. This isn't just up to anyone's whim because we have principles that work about equal concern and basic liberty. Even if you don't accept that, odd can be interpreted as having something to do with the overall meaning of the Constitution.
