Is Circuit Judgment Counted for Criminal Purpose?

The court claims it's an open question whether or not circuit precedent counts for ficy established law. There are several cases where, you know, you sue somebody for unconstional action, the eleventh circuit says hat their circuit cord upheld, upholds it,. but other circuits would have said it was unconstitutional. The case goes to the supreeme courts.
