The three words that should scare any index provider are facts and circumstances. That is the test to determine if you are promoting a security without registration. It seems like the weirdest loophole, and it seems wrong, is that the right word? Are they getting increasingly interested in that, or is that part of this whole story that you're weaving? A i think definitely something they're looking at.
