The Importance of Due Process Clauses
The court ruled that DSS can take all sorts of actions to protect Joshua's life. Justice Brennan said the knowledge of an individual's predicament and the expression of intent to help him are what should matter here. The question shouldn't be whether the government caused the situation, but how much responsibility it has for a child in its custody.
