The D.C. Circuit
The DC Circuit has expressed concern about an indirect vague standard in joint employer. The Obama administration is likely to have trouble with that because they are clearly acting in defiance of what the appeals court told them. There is pending right now a case over where appeals from NRV rules are supposed to be filed, so we're hoping they figure out before these rules go final.
