The Risk of Unrecognised Trade Unions Picking Outside the Factory

There are a maximum number of people that can stand outside the building. Does that maximum apply when a union is trying to recruit members? My reading is that it's not picketing because it's not about trade dispute but you would be still looking to see whether there's a tort or something like public nuisance or trespass. A lot of employers think I find that I don't know about you Sarah, thought they immediately go to chest thumping and try to shout out where the employer don't get in our way. But if the employer is reasonable and rational very often things calm down quite quickly. The law is clear that information and consultation is different to recognition. They have different functions, different purposes
