If you're taking the original work, making a different version of it and selling into the same market, that first owner is going to lose market share. If you're competing with the original owner, that's also going to weigh against fair use. It took almost 11 years to get to the Supreme Court ruling where the Supreme Court ruled that Google's use of the Java API was fair use. In general, the AI. court systems are so mismatched. Like how can the court systems be relevant when the rate of change that's happening in the AI industry?
