The question about partisan gerrymandering is not just dishable, but there's certainly a broader question. The implications of this is our democracy functioning. If you believe the Constitution creates any sort of obligation upon government officials to further a government that is reflective of the will of its citizens, then there cannot be a question that this shit is unconstitutional.
