The Importance of Race-Based Admissions Programs in Military Academies
The court is saying, maybe the military academies can keep doing quota-based checkbox. No military academy is part party to these cases and none of the courts below addressed the propriety of race-based admission system in that context. This opinion also does not address the issue in light of the potentially distinct interests that military academies may present. And this was brought up in oral argument several times. The idea that the military Academies have absolutely a need to have racial specific racial diversity in order to have that type of diversity in its fighting men and women. That that is a specific compelling interest at those military colleges and universities have.
