Sotomayor wrote a fairly scathing dissent saying, of course, you can't use deadly force unless it's necessary. She also said that the court is endorsing a shoot first, think later mentality and stated that it rendered the promises of the Fourth Amendment hollow. So the court holds again eight to one that the officer was entitled to qualified immunity. But lucky for the police, Antonin Scalia was still on the Supreme Court at the time. And he files a concurrence saying, yeah, yeah, the majority is totally right.
