The defense attorney said we feel he's either guilty of first degree murder or should be acquitted. The prosecution argued that under Vermont law, an accessory can be found guilty of a more serious crime than the principal. So they asked the judge for a judgment of acquittal before they even start their case. He ends up dismissing the jury when they are hopelessly deadlocked at 11 to one for conviction. And it is a mistrial there. They're going to try them again in April of 1976.
