The Constitution doesn't say a whole lot about copyright. The way that it gets there is by saying we're going to protect creators from copycats, but that protection is also limited. Over the next 200 years, judges decide it's okay to copy sometimes. There are times when stuff might be fair to use. Fair use is entirely created by judges.
