The defense argued that Dax Max never confessed to J Love or Michael Argetta. The court heard that Dax was an unemployed man trying to raise two children, and he was also terrified that the crime organization would harm him if he didn't come up with some sort of confession. His defense lawyer argued that when it came to the two recorded confessions he gave to Rory and Mr. Big, his Defense Lawyer argued that he only confessed because he wanted to impress the members of the crime organization.
