During the lame duck session of Congress between the election and the new president being sworn in, the outgoing Federalist majority created new judicial posts. If they staffed them with Federalists, there would be no way under the Constitution that the president could easily remove them. The only provision for removal of such person in the Constitution is that Congress has to impeach and convict him.
