In both of these cases, the victims were shot while on personal property. Under Missouri's Castle Doctrine, a homeowner has no duty to retreat from what they reasonably believe to be a deadly threat. In New York, the homeowner does have a duty to retreat before resorting to deadly force. So because Gillis didn't exit the car before she was shot, the shooter will presumably have a harder time defending his decision to shoot.
