Ungabunga: I would take a different variation on this, one which to my knowledge, no legal scholars advocating, so it's probably bunk. If you're going to abrogate somebody's freedom of speech or free association, he says, that needs to pass strict scrutiny. But with things that are ephemeral, like a wedding cake, and the damage is one of not feeling included, I don't think that passes strict scrutiny. Ungabunga also believes in the industrial complex where people push cases that they know they want precedent on.
