Not all IRBs are created equal. The ones that are potentially maybe at bigger academic centers tend to be more obstructionist than theIRB is that are run by more private organizations. If you get IRB approval, you're immune from suit and then let the researchers themselves decide whether they want to take the shelter of an IRB or whether they're willing to go it on their own. It's the structure of IRBs that makes it inevitable that you will get these disastrous consequences.
