Cuban Detainees - The Fifth Amendment
Judge Shubes had presided over two other major cases dealing with the Cuban refugees. In these rulings, he came up with a clever argument. Basically, you can't be held without a charge. But almost every time Judge Shub ruled against the federal government, he was appealed by the DOJ.
