I think we should take this decision at face value. It means that the special counsel's office did not believe that they could prove insurrection, which would have been the most serious offense had it been readily provable. I think Jack Smith really threads the needle here, especially with this last part of the manner and means where they talk about exploiting the violence. But also the way it sprinkled throughout the entire indictment, you leave this indictment securely believing that Donald Trump was involved, was at the center of everything, whether he's charged with it or not.
