In a prior life, Merrick Garland was himself a federal prosecutor. He oversaw the prosecution where death was sought of Timothy McVay. I think that is a sensibility that he is applying even as he has taken the death penalty off the table in many different cases. It just explained to folks who may not appreciate this.
