There's a technical argument that no one isn't controlled because there's no admin key associated with the contract. The CFTC, which basically says almost anything under the sun is a commodity, has asserted even publicly that, you know, crypto is really under their umbrella. For me, it's not clear to me why any one particular agency or any one particular approach is going to win out over any of the others.
